TERMS AND CONDITIONS

1. Definitions

1.1 "Safetytech Fire” shall mean Safetytech Fire Services Pty Ltd its successors and assigns or

any person acting on behalf of and with the authority of Safetytech Fire Services Pty Ltd.

1.2 “Customer” shall mean the Customer (or any person acting on behalf of and with the authority of the Customer) as described on any quotation, work authorisation or other form as provided by Safetytech Fire to the Customer.

1.3 “Guarantor” means that person (or persons) who agrees to be liable for the debts of

the Customer on a principal debtor basis.

1.4 "Goods" shall mean all Goods supplied by Safetytech Fire to the Customer (and where the context so permits shall include any supply of Services as hereinafter defined) and are as

described on the invoices, quotation, work authorisation or any other forms as provided by

Safetytech Fire to the Customer.

1.5 "Services" shall mean all Services supplied by Safetytech Five to the Customer and includes any advice or recommendations (and where the context so permits shall include any supply of Goods as defined above).

1.6 “Price” shall mean the Price payable for the Goods as agreed between Safetytech Fire

and the Customer in accordance with clause 13 of this contract.

2. The Competition and Consumer Act 2010 (“CCA") and Fair Trading Acts (“FTA”)

2.1 Nothing in this agreement is intended to have the effect of contracting out of any applicable provisions of the CCA or the FTA in each of the States and Territories of Australia (including any substitute to those Acts or re-enactment thereof), except to the extent permitted by those Acts where applicable).

3. Agreement

3.1 This Agreement means an agreement between Safetytech Fire Services Pty Ltd (Safetytech Fire) and the Customer relating to the sale and/or supply and/or installation and/or maintenance of Goods and services (as described on the invoices, quotation, work authorisation or any other forms as provided by Safetytech Fire to the Customer) and includes all relevant schedules, forms, specifications and other referenced materials. These terms and conditions supersede any other agreements, or understandings (whether written or oral) and, in particular, any conditions contained in the Customer's order unless Safetytech Fire has expressly agreed in writing by initiating each such requested Customer's term(s). No variation, waiver, or cancellation of the Agreement will be effective unless signed in writing by each party and any failure by Safetytech Fire to enforce any clause of this Agreement will not be construed as a waiver of Safetytech Fire's rights under this Agreement. This Agreement applies whether or not it is signed.

3.2 Any instructions received by Safetytech Fire from the Customer for the supply of Goods or services and/or the Customer's acceptance of Goods supplied or services provided by Safetytech Fire shall constitute acceptance of the terms and conditions contained herein.

3.3 Upon acceptance of these terms and conditions by the Customer the terms and conditions are binding and can only be amended with the written consent of Safetytech Fire.

3.4 The Customer shall give Safetytech Fire not less than fourteen (14) days prior written notice of any proposed change of ownership of the Customer or any change in the Customer's name and or any other change in the Customer's details (including but not limited to changes in the Customer's address contact details, or business practice). The Customer shall be liable for any loss incurred by Safetytech Fire as a result of the Customer's failure to comply with this clause.

3.5 Where more than one Customer has entered into this agreement, the Customers shall be jointly and severally liable for all payments.

4. Site Charges and Assumptions

4.1 Unless otherwise agreed in writing, charges for work performed:

(a) are based on work being carried out from 08:30 to 17:00 Monday to Friday

except for Public Holidays and subject to alteration by Safetytech Fire.

(b) are based on having continuous, uninterrupted, and unhindered access to the

required people, equipment, facilities, and areas where the work is to be carried out, and 

(C) do not cover extraneous work, patching/painting, carpet lifting or refitting, building work or decoration and, should Safetytech Fire agree to carry out such work at the request of the Customer then Safetytech Fire shall not be liable for any damage arising.

4.2 All additional costs arising from clause 4.1 above and any alteration to the specifications required by the Customer including any interruption or delays by the Customer, its employees, agents, or other trades during the course of work performed may result in additional charges including the reasonable costs of delay.

4.3 if it becomes necessary to pay any additional site allowances, other than a State or Federal award or amounts in excess of any current workplace agreement applicable to the type of work being performed these costs will be added to the Fee.

4.4 in the event that Safetytech Fire has agreed to deliver the Services by a date agreed between the parties and such delivery is delayed by the occurrence of a Force Majeure Event (as set out in clause 16) or by any third party, or the Customer or its agents, Safetytech Fire shall be entitled to a reasonable extension of time to complete the Services and compensation for additional costs incurred.

4.5 Any variations to the Services required by the Customer must be agreed in writing by both parties and will be priced in accordance with Safetytech Fire's standard price lists and shall include an amount for any design, management, overheads and profit.

4.6 Emergency service call-outs wit be charged in accordance with Safetytech Fire's standard fees for such emergency services

5. Additional services

5.1 If the Customer requests Safetytech Fire to provide additional services in writing setting out the requested scope of such additional services beyond those described in this Agreement and Safetytech Fire agrees, the terms of this Agreement apply to the additional services and the Customer must pay for the additional services at the following rate(s):

(i) if Safetytech Fire has quoted an amount before providing the additional services, the

amount quoted, and 

(ii)Safetytech Fire has not given any quote, an amount calculated for the additional services provided at Safetytech Fire's standard rates for such additional services applicable at that time.

6. Delivery

6.1 Safetytech Fire shall use reasonable endeavours to complete delivery of the Goods and Services. However, delivery dates or periods quoted are estimates only and are subject to prompt receipt of all Customer information, other material, and permits from the Customer necessary to allow Safetytech Fire to proceed with the delivery of the Goods and Services. Safetytech Fire accepts no liability whatsoever for any loss or damage suffered by the Customer as a consequence of any delay or failure to deliver the Goods and Services.

6.2 Risk in the Goods shall pass upon delivery to the Customer. Title to and ownership of the

Goods shall pass to the Customer upon payment.

6.3 Safetytech Fire is deemed to have delivered the Goods when the Goods are made available to Customer for physical collection by or on behalf of Customer at Customers nominated delivery point (Delivery). Any unloading or loading shall be Customer's responsibility, unless Safetytech Fire otherwise agrees in writing.

6.4 Safetytech Fire may deliver the Goods by installments (where, in Safetytech Fire's opinion,

this is reasonable) and issue interim invoices to Customer.

6.5 Without limiting any other provision of the Agreement, failure by Customer to pay any installment, or any other amount when due, will entitle Safetytech Fire to withhold or delay delivery of any remaining Goods ordered.

6.6 if Customer is unable to collect the Goods at Customer's nominated delivery point on the delivery day. Safetytech Fire may (at its option and without limiting its other rights and remedies) arrange suitable storage of the Goods, whether at its premises or elsewhere, and Customer must pay or reimburse at costs and expenses of storage, insurance, demurrage, handling and other charges associated with such storage. Notwithstanding Customer's inability to collect the Goods Delivery is deemed to have occurred.

6.7 The Customer must not install, store or in any way incorporate the Goods in any aircraft or in any vessel intended to fly or move in or through the atmosphere or space.

6.8 The Customer acknowledges that it has the sole responsibility to confirm the suitability of the Goods for their intended purpose.

6.9 At Safetytech Fire's sole discretion the costs of delivery are in addition to the Price and for the Customer’s account.

6.10 The Customer shall make at arrangements necessary to take delivery of the Goods whenever they are tendered for delivery. In the event that the Customer is unable to take delivery of the Goods as arranged then Safetytech Fire shall be entitled to charge a reasonable fee for redelivery.

6.11 The failure of Safetytech Fire to deliver shall not entitle either party to treat this contract as

repudiated.

6.12 Safetytech Fire shall not be liable for any loss or damage whatsoever due to failure by Safetytech Fire to deliver the Goods (or any of them) promptly or at all where due to circumstances beyond the control of Safetytech Fire.

6.13 Where the Customer expressly requests Safetytech Fire to leave Goods outside Safetytech Fire's premises for collection or to deliver the Goods to an unattended location then such Goods shall be left at the Customer's sole risk and it shall be the Customer's responsibility to ensure the Goods are insured adequately or atall.

7. Customer's Responsibilities

The Customer shall:

7.1 Provide Safetytech Fire with access to the site as reasonably required for the purpose of allowing Safetytech Fire to perform its obligations under this Agreement:

 (a) ensure that its employees, agents and other contractors shall:

(i) ) not interfere with or disrupt, delay or hinder Safetytech Fire, its employees agents, subcontractors, agents or other persons engaged by Safetytech Fire or prevent them from carrying out their work or cause them to incur additional cost; and 

(ii) reasonably cooperate with Safetytech Fire and its employees, agents and subcontractors;

 (b) advise Safetytech Fire of the existence of any concealed pipes, wires and cables for water, gas, electricity, telephone or other services affecting the premises and shall confirm the location of such services to Safetytech Fire's technician before work commences. In the absence of such notice Safetytech Fire accepts no liability for any loss or damage to such services or any consequence thereof and the Customer agrees to indemnity Safetytech Fire against any claim whatsoever for any loss or lability under this clause;

 (c) provide Safetytech Fire with data specifications and information as may be requested by Safetytech Fire to enable it to fulfill its obligations under this Agreement;

 (d) provide adequate facilities at the premises at no cost to Safetytech Fire. Including parking power, lifting equipment, scaffolding, scissor lifts, and rubbish removal skips;

(e) ensure that the premises an at all times a safe working environment and (without imitation) will not contain asbestos or similar hazards. If Safetytech Fire considers that the premises are unsafe it may delay or cease delivery of the Services until the premises are restored to a safe condition. Any such delay or cessation of the Services:

(i) will entitle Safetytech Fire to an extension of time to complete the Services; 

(ii) will not constitute a breach of this Agreement; and

(iii) will not entitle the Customer to the payment of liquidated damages or a

financial penalty, and

(f) indemnify Safetytech Fire against any claims for the failure of fire alarm monitoring equipment, telecommunication carrier lines, power supply, costs relating to emergency services charges, or relocation of equipment.

8. Drawings

8.1 Safetytech Fire require, free of charge, architectural design drawings in AutoCAD or DXF format to be made available with sufficient information to enable layout drawings to be prepared. Where documentation is supplied by way of  electronic media, it is the Customer's responsibility to ensure that they will be supplied uncontaminated/virus free.

9. Warranty and Goods Returns

9.1 For Goods not manufactured by Safetytech Fire, the warranty shall be the current warranty provided by the manufacturer of the Goods. Safetytech Fire shall not be bound by nor be responsible for any term, condition, representation or warranty other than that which is given by the manufacturer of the Goods.

9.2 The warranty shall commence from the date of completion of installation of Goods, or for Goods sold on a supply only or supply and commission basis upon delivery of the Goods to the Customer (“Warranty Period”).

9.3 During the Warranty Period any Goods that prove to be defective will be repaired or replaced by Safetytech Fire at its option.

9.4 The warranty provided under this Agreement is dependent upon regular maintenance work being carried out to an Australian Standard or Manufacturer’s Recommendations.

9.5 The parties agree that when evaluating a claim for defect, due allowance shall be made for fair wear and tear of the Goods. Should the Customer or any other party attempt to carry out repairs, operate or modify the Goods in any way during the Warranty Period. Safetytech Fire shall be relieved of its obligations under the warranty provisions. In addition, the warranty does not cover work required to be done to repair a defect or damage caused by the Customer's negligence, fault, neglect, abuse incorrect use or as a result of vandalism, fire, water damage, power surge or other circumstance outside of Safetytech Fire's control or that of the manufacturer.

9.6 The Customer shall inspect all Goods upon delivery and within 5 business days of delivery, give written notice to Safetytech Fire if any of the Goods are not in accordance with the Customer’s order.

9.7 Safetytech Fire will accept Goods returned for credit where Safetytech Fire has incorrectly suppiled a Goods or the Goods has been damaged in transit by Safetytech Fire's carrier.

9.8 Goods may not be returned for credit without obtaining prior written authorisation from Safetytech Fire.

9.9 Goods returned for credit, except under 9.7 above, shall be subject to a 15% or $20.00 (whichever is greater) restocking fee and except where Goods are returned under f) above, all freight charges for goods returned for credit shall be prepaid by the Customer unless otherwise approved by Safetytech Fire in writing.

10. Intellectual Property

10.1 Safetytech Fire retains all rights, title and interest in any intellectual property including any design(s), documentation, diagrams or plans existing or arising during the course of the work under this Agreement. All intellectual property supplied by the Customer at the commencement of this Agreement remains the property of the Customer but the Customer grants Safetytech Fire a perpetual irrevocable, royalty free, non-exclusive licence to use, reproduce and modify the Customer's Intellectual property. The Customer indemnifies Safetytech Fire for any threatened or actual claim of intellectual property infringement arising out of Safetytech Fire's use of the Customer's intellectual property.

11. Safetytech Fire's Liability

11.1 Nothing in this Agreement excludes, restricts or modifies the application of the provisions of any statute (including the Trade Practices Act 1974) where to do so would contravene that statute or cause any part of this Agreement to be void.

11.2 To the extent permitted by law, Satetytech Fire's aggregate liability under this Agreement whether in contract, tort (including negligence) or otherwise, will be limited to the value of payments received by Safetytech Fire from the Customer.

11.3 Notwithstanding anything else in this Agreement, Safetytech Fire will not be liable for:

i) any indirect, consequential or special or economic loss, cost, liability, damage or expense howsoever arising; or

ii) loss of profit, loss of use, loss of income, loss of rental or other benefit, loss of production, loss of actual or potential business opportunity or loss of reputation.

11.4 The Customer acknowledges and agrees that it is reasonable for Safetylech Fire to limit its lability under this Agreement.

12. Hydrostatic testing

12.1 Before any hydrant mains turned off Safetytech Fire recommend an authorised person from the company or premises assist with an inspection of the fire service, so timetable can implemented for the purpose of minimising the risk areas which cannot be shut down due to operational and safety to employees on site while working.

12.2 Pressure testing of the fire hydrant service pipe work can cause some systems to fail or burst under the require pressure of 1700 kPa, Safetytech Fire encourage all its customers to take the appropriate action in notifying their insurance company, employees, contractors, on the day of the test. Safetytech Fire accepts no liability whatsoever for system failure caused by the test and any damage caused as a result of the performance of the test, regardless of anything else stated in this agreement and regardless of any act or omission by Safetytech Fire. This quotation does not allow for the repairing of any pipe work or valves which leak whin conducting the pressure testing procedure.

12.3 Before conducting the hydrostatic test all steps will be taken to ensure the fire hose reels are fully shut down at isolating valve at reel and the fire hydrants are not leaking from washers. Fire Sprinkler systems shall be isolated at the main isolation valve.

12.4 Servicing of any underground check valves or isolating valves which may be instated in a pit are excluded from this quotation and will be quoted separately, unless otherwise stated in the quotation.

12.5 Safetytech Fire endeavor to minimize any damage to existing services which may occur whilst carrying out hydraulic scope of works. Unless otherwise noted in our tender proposal, no allowance has been made to re-instate or replace concrete, concrete floors, roadways, paths, paving, removal, or reinstalment of gardens, fencing or reticulation.

12.6 Safetytech Fire isolate existing isolation valves both above and below ground in order to carry out works on existing fire service systems. It is understood and agreed that Safetytech Fire assume all valves to be in good working order and shall not be held responsible for any issues arising during or after the isolation and re-instatement process, including but not limited to flood damage, fittings or pipe work failure, leakage or any other related damages.

13. Insurances

13.1 Safetytech Fire will maintain $5 million public liability insurance and Workers Compensation insurance.

13.2 The Customer must keep the Goods insured against all risks for Goods of that kind from the time the risk in the Goods passes to Customer until the time that title to the Goods passes to Customer. Customer holds the proceeds of that insurance on trust for Safetytech Fire up to the amount it owes Safetytech Fire in respect of those Goods and must keep such proceeds in a separate account until the liability to Safetytech Fire is discharged and must immediately pay that amount to Safetytech Fire.

14. Price, Fees and Charges

14.1 At Safetytech Fire's sole discretion the Price shall be either:

(i) As indicated on invoices provided by Safetytech Fire to the Customer in respect of

Goods supplied; or

(ii) Safetytech Fire's current price at the date of delivery of the Goods according to Safetytech Fire's current Price list; or

(iii) Safetytech Fire's quoted Price (subject to clause 20) which shall be binding upon

Safetytech Fire provided that the Customer shall accept Safetytech Fire's quotation in

writing within thirty (30) days.

14:2 Safetytech Fee reserves the right to change the Price in the event of a variation to Safetytech Fire's quotation. Any variation from the plan of scheduled works or specifications (including, but not limited to, any variation as a result of additional works required due to hidden or unidentifiable difficulties or as a result of increases to Safetytech Fire in the cost of materials and labour) will be charged for on the basis of Safetytech Fire's quotation and will be shown as variations on the invoice.

14.3 At Safetytech Fire’s sole discretion a non-refundable deposit may be required.

14.4 Safetytech Fire may submit detailed progress payment claims in accordance with Safetytech Fire’s specified payment schedule. Such payment claims may include the reasonable value of authorised variations and the value of any materials delivered to the site but not yet installed.

14.5 At Safetytech Fire's sole discretion:

(a) payment shall be due on delivery of the Goods; or

(b) payment for approved Customers shall be due thirty (30) days following the end of

the month stated on the invoice.

14.6 Time for payment for the Goods shall be of the essence and will be stated on the invoice or

any other forms. If no time is stated then payment shall be due seven (7) days following the date

of the invoice.

14.7 Payment will be made by cash, or by cheque, or by bank cheque, or by credit card (plus surcharge of up to two and a half percent (2.5%) of the Price), or by direct credit, or by any other method as agreed to between the Customer and Safetytech Fire.

14.8 GST and other taxes and duties that may be applicable shall be added to the Price except

when they are expressly included in the Price.

14.9 The Customer agrees to pay Safetytech Fire the fees specified in this Agreement without set-off, deduction or discount of any kind.

14.10 Title to and ownership of the Goods shall pass to the Customer upon final payment of the fees specified in this Agreement, despite delivery of the Goods. Therefore, for the avoidance of doubt, the Goods remain the sole and absolute property of Safetytech Fire as full legal and equitable owner until such time as the Customer has paid Safetytech Fire the full purchase price together with the full price of any other Goods the subject of any other contract with Safetytech Fire. Risk in the Goods shall pass to the Customer upon delivery.

14.11 The Customer acknowledges that he receives possession of and holds Goods delivered by Safetytech Fire solely as bailee for Safelytech Fire until such time as the full price thereof is paid to Safetytech Fire together with the full price of any other Goods then the subject of any other contract with Safetytech Fire.

14.12 Until such time as the Customer becomes the owner of the Goods, he will:

i) store them on the premises separately.

ii) ensure that the Goods are kept in good and serviceable condition;

iii) cure the Goods from risk, damage and theft; and

iv) keep the Goods fully insured against such risks that are usual or common to insure

against in a business of a similar nature to that of the Customer.

14.13 Until the Goods are paid for in full, Safetytech Fire authorises the Customer to sell the

Goods as its agent, however, the Customer shalt not represent to any third parties that it is acting in any way for Safetytech Fire. Safetytech Fire will not be bound by any contracts with third parties to which the Customer is a party. Records shall be kept by the customer of any Goods Owned by Safetytech Fire. The proceeds of any sale of the Goods shall be paid into a separate account and held in trust for Safetytech Fire. The Customer shall account to Safetytech Fire from this fund for the full price of the Goods. If the Customer is entitled to a period of credit, but if prior to the expiration of the period of credit the Goods are sold and the proceeds of sale received, the Customer shall account forthwith to Safetytech Fire for the price of the Goods.

14.14 Should the Customer die, stop payment or call a meeting of its creditors or become insolvent or subject to the bankruptcy laws or being a company calls a meeting for the purpose of or to go into liquidation or has a winding-up petition presented against it or has a receiver or administrator appointed, Safetytech Fire may at its option notwithstanding its waiver of such default or failure and without prejudice to its other rights under this Agreement suspend or cancel this Agreement or require payment in cash before or on delivery or tender of Goods or documents notwithstanding terms of payment previously specified or may repossess and take over the Goods and dispose of the same in its own interest without prejudice to any claim it may have for damages for any loss resulting from such resale.

14.15 In the event that the Customer uses the Goods in some manufacturing or construction process of its own or some third party, then the Customer shall hold such part of the proceeds of such manufacturing or construction process as relates to the Goods/Goods in trust for Safetytech Fire. Such part shall be deemed to equal in dollar terms to the amount owing by the Customer to Safetytech Fire at the time of the receipt of such proceeds.

14.16 If the Customer does not pay for any Goods on the due date then Safetytech Fire is hereby irrevocably authorised by the Customer to enter the Customer's premises or any premises under the control of the Customer as agent of the Customer and use reasonable force to take possession of the Goods without liability for the fort of trespass, negligence or payment of any compensation to the Customer whatsoever. On retaking possession of the Goods Safetytech Fire may elect to refund to the Customer any part payment that may have been made and to credit the Customer's account with the value of the Goods less any charge for recovery of the Goods, or to resell the Goods .

14.17 Safetytech Fire shall have the right to adjust the fees periodically in respect of an increase/fall in the cost of its services.

"Hydrostatic Pressure Testing Clause (Hydrants):

Safetytech Fire Services provides hydrostatic pressure testing services for existing Fire Hydrant Systems. It is understood and agreed that Safetytech Fire Services shall not be held responsible for any issues arising during or after the hydrostatic pressure testing process, including but not limited to flood damage, fittings or pipe work failure, or any other related damages.

  1. Assumption of Responsibility: The client acknowledges that Safetytech Fire Services is solely responsible for conducting the hydrostatic pressure testing according to industry standards and guidelines. The client understands that Safetytech Fire Services has no control over the condition, age, materials, or previous installation of the Fire Hydrant System, as it is an existing system installed by other companies.
  2. Limitation of Liability: The client agrees that Safetytech Fire Services, its employees, and representatives shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising from or related to the hydrostatic pressure testing, including, but not limited to, flood damage, fittings or pipe work failure, property damage, or personal injury.
  3. Indemnification: The client agrees to indemnify and hold harmless Safetytech Fire Services, its employees, and representatives from any claims, liabilities, costs, damages, or expenses (including reasonable attorney's fees) arising out of or related to any issues arising during or after the hydrostatic pressure testing process, including but not limited to flood damage, fittings or pipe work failure, or any other related damages.
  4. Compliance with Regulations: Safetytech Fire Services will perform the hydrostatic pressure testing in compliance with applicable laws, regulations, and industry standards. However, it is the client's responsibility to ensure that the Fire Hydrant System complies with all relevant local codes, standards, and regulations.
  5. Safetytech Fire Services results DO NOT constitute acknowledgement of the system/s compliance with codes, standards, or regulations,
  6. "Superseding Purchase Order/Contract Clause:

The client acknowledges and agrees that this quotation, along with its attached terms and conditions, constitutes the entire agreement between Safetytech Fire Services and the client regarding the hydrostatic pressure testing services. Any purchase order or contract provided by the client shall not supersede or modify the terms and conditions stated herein, unless expressly agreed upon in writing by both parties.

In the event of a conflict between the terms and conditions of the client's purchase order or contract and those contained in this quotation, the terms and conditions outlined in this quotation shall prevail, unless otherwise mutually agreed upon in writing by both parties.

By accepting this quotation or proceeding with the hydrostatic pressure testing services, the client acknowledges and agrees to be bound by the terms and conditions stated herein, irrespective of any conflicting terms in their purchase order or contract."

By signing below, the client acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this Hydrostatic Pressure Testing Clause."

 

 

"Hydrostatic Pressure Testing Clause (Sprinklers):

Safetytech Fire Services provides hydrostatic pressure testing services for existing Fire Sprinkler Systems. It is understood and agreed that Safetytech Fire Services shall not be held responsible for any issues arising during or after the hydrostatic pressure testing process, including but not limited to flood damage, fittings or pipe work failure, or any other related damages.

  1. Assumption of Responsibility: The client acknowledges that Safetytech Fire Services is solely responsible for conducting the hydrostatic pressure testing according to industry standards and guidelines. The client understands that Safetytech Fire Services has no control over the condition, age, materials, or previous installation of the Fire Sprinkler System, as it is an existing system installed by other companies.
  2. Limitation of Liability: The client agrees that Safetytech Fire Services, its employees, and representatives shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising from or related to the hydrostatic pressure testing, including, but not limited to, flood damage, fittings or pipe work failure, property damage, or personal injury.
  3. Indemnification: The client agrees to indemnify and hold harmless Safetytech Fire Services, its employees, and representatives from any claims, liabilities, costs, damages, or expenses (including reasonable attorney's fees) arising out of or related to any issues arising during or after the hydrostatic pressure testing process, including but not limited to flood damage, fittings or pipe work failure, or any other related damages.
  4. Compliance with Regulations: Safetytech Fire Services will perform the hydrostatic pressure testing in compliance with applicable laws, regulations, and industry standards. However, it is the client's responsibility to ensure that the Fire Sprinkler System complies with all relevant local codes, standards, and regulations.
  5. Safetytech Fire Services results DO NOT constitute acknowledgement of the system/s compliance with codes, standards, or regulations,
  6. "Superseding Purchase Order/Contract Clause:

The client acknowledges and agrees that this quotation, along with its attached terms and conditions, constitutes the entire agreement between Safetytech Fire Services and the client regarding the hydrostatic pressure testing services. Any purchase order or contract provided by the client shall not supersede or modify the terms and conditions stated herein, unless expressly agreed upon in writing by both parties.

In the event of a conflict between the terms and conditions of the client's purchase order or contract and those contained in this quotation, the terms and conditions outlined in this quotation shall prevail, unless otherwise mutually agreed upon in writing by both parties.

By accepting this quotation or proceeding with the hydrostatic pressure testing services, the client acknowledges and agrees to be bound by the terms and conditions stated herein, irrespective of any conflicting terms in their purchase order or contract."

"Boosted Flow Testing Clause:

Safetytech Fire Services provides boosted flow testing services for existing Fire Hydrant Systems. It is understood and agreed that Safetytech Fire Services shall not be held responsible for any issues arising during or after the boosted flow testing process, including but not limited to flood damage, fittings or pipe work failure, or any other related damages.

  1. Assumption of Responsibility: The client acknowledges that Safetytech Fire Services is solely responsible for conducting the boosted flow testing according to industry standards and guidelines. The client understands that Safetytech Fire Services has no control over the condition, age, materials, or previous installation of the Fire Hydrant System, as it is an existing system installed by other companies.
  2. Limitation of Liability: The client agrees that Safetytech Fire Services, its employees, and representatives shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising from or related to the boosted flow testing, including, but not limited to, flood damage, fittings or pipe work failure, property damage, or personal injury.
  3.
